The Pennsylvania Supreme Court issued a ruling yesterday refusing to hear a challenge to an appellate decision which affirmed that Pennsylvania’s non-biological, non-adoptive same-sex parents have the right to primary custody of their children. The Center for Lesbian and Gay Civil Rights was co-counsel in the case, Jones v. Boring, with Maureen Gatto of Dorian, Goldstein, Wisniewski & Orchinik, Lambda Legal, and the National Center for Lesbian Rights.

The case involved a lesbian couple, Patricia Jones and Ellen Boring, who lived together for several years and had twins together through alternative insemination. Although not the biological mother of the children, Patricia Jones took on all the responsibilities of a co-parent to the boys.

Yesterday’s ruling by the Pennsylvania Supreme Court effectively ends Boring’s challenge to Jones’s right to primary custody, and makes permanent the Superior Court’s determination regarding the custody rights of in loco parents. For more information on the case, visit  www.center4civilrights.org

While not a primarily LGBT issue, Universal Health Care is something for which we should all fight. Universal health care would eliminate the health care coverage concerns of everyone. It would end the “same sex” and “domestic” partner health care debate - by automatically covering everyone under the universal plan.

In Pennsylvania there are two bills currently in the legislature that would make Universal Health care a reality. In the PA Senate it is bill S1085 and in the State House it is H2722. You can look up the bills here to see if your State Senator or Representative is a co-sponsor of these important bills or to read the whole bill. You should contact your local State Senator and Representative and tell them they should vote for these bills. You can find out how to contact them here.

In the United States Congress there is HR 676, the United States National Health Insurance Act by Congressman John Conyers of Michigan as well as Reps. Dennis Kucinich, Jim McDermott and Donna Christensen. The bill would create a publicly financed, privately delivered health care system that uses the already existing Medicare program by expanding and improving it to all U.S. residents, and all residents living in U.S. territories. The goal of the legislation is to ensure that all Americans will have access, guaranteed by law, to the highest quality and most cost effective health care services regardless of their employment, income, or health status. With the Democrats controlling Congress as of January it is the best chance in years to make progress on this issue. It is shameful that a country as advanced technologically and scientifically as the United States allows such a large segment of it’s population to do with out adequate health care because they are uninsured and cannot afford to pay for medical care. And if some one who is uninsured actually has a major medical problem forget it. It actually ends up costing more because people who cannot afford to pay put off medical care until it becomes something major and then the cost go out of control.

It’s pretty sad when the third world is ahead of the bastion of freedom that is the USA. A number of European countries are way ahead of us. I expect Europe to be ahead of us, as they are more sophisticated and do let religion run their country, but not the third world.
